High Court slaps fine of Rs 5 lakhs on Bihar police for arrest without FIR

Patna, Dec 22 (UNI) Patna High Court today slapped fine of Rs 5 lakhs on Bihar police for arrest of driver of a milk tanker without lodging FIR in connection with offence allegedly committed by him.
A division bench comprising Chief Justice Sanjay Karol and Justice S Kumar, today directed Bihar government to pay Rs 5 lakhs as compensation to driver of a milk tanker Jitendra Kumar within six weeks for his arrest by Bihar police without lodging FIR against him in connection with offence allegedly committed by him.
Arrest of Jitendra without an FIR against him, was violation of fundamental right under Article 21 of the constitution, the court observed.
The Court also directed DGP of Bihar to ensure action against the erring cops in the case under various sections of Bihar Police Manual and relevant laws. DGP was also directed to take steps for sensitising all police stations across the state so that such cases particular relating to violation of fundamental rights could not get repeated in any part of the state.
As it is, Jitender Kumar, driver of a milk tanker of Uttar Pradesh was arrested in Saran district after the vehicle knocked down a man in Saran district during lockdown before May 15. When Jitendra was not traced, a petition was filed online in Patna High Court and it came to light that FIR was lodged in this connection on June 3 while driver was arrested before May 15.
