YAMUNANAGAR: The court of Yamunanagar district sessions judge (DSJ) Deepak Aggarwal convicted three accused persons and sentenced them life imprisonment each in a case of the murder of a juvenile based on the evidence of the last scene theory and call details, deputy district attorney (DDA), Sanjeev Kumar said.
The court pronounced the decision on Monday and imposed a fine of Rs 17,000 each on the convicts identified as Naseem and Abdul Rehman, both of Bhud Kalan village and Noor Hassan of Kutipur village of Yamunanagar district, and in default of fine payment, the convicts shall further undergo simple imprisonment for one year.
As per the information, on August 1, 2019, Deshraj of Khilla Wala village in Chhachhrauli area of Yamunanagar district lodged a complaint with the police that his son, Lucky Pal (16), was working at the barber shop of Naseem at Kutipur road in Pratap Nagar for the last one year.
“On July 25, 2019, at about 8pm, Lucky Pal left the house for the shop, saying that he would go to Haridwar in the night for bringing Kawad. Later, his mobile phone became switched off in the night”, complained Deshraj.
On this complaint, a case was registered under Section 365 (kidnapping) of the Indian Penal Code (IPC) against unknown person at Pratap Nagar police station on August 1, 2019.
Deshraj later moved an application to the superintendent of police (SP) of Yamunanagar alleging that during search of his son, he came to know that on the night of July 25, 2019, four boys were consuming liquor on the bank of a canal near Herbal Park of Pratap Nagar block.
The complainant alleged suspicion that Naseem, Abdul Rehman and Noor Hassan might have done something wrong to his juvenile son.
The police later arrested Naseem, Abdul and Noor Hassan, after the investigation.
In the police interrogation, the accused persons revealed that they were consuming liquor in the evening sitting on the bank of the canal on July 25, 2019 and they called the juvenile there along with cold drinks and snacks.
“While consuming liquor, Noor Hassan and Lucky had heated arguments over some issue. Noor along with Abdul Rehman caught hold of juvenile. Noor Hassan in a fit of anger and to kill juvenile pushed him in the canal where he drowned," told to the police the convicts.
DDA Sanjeev said, “The dead body the deceased Lucky is yet to be recovered but on the basis of the evidence established of last scene theory, and call details, the three accused persons have been convicted by the court under Section 302 (punishment for murder), 201 (causing disappearance of evidence) and 34 (common intention) of the Indian Penal Code (IPC).”
