Dutch Minister for Justice and Security Ferd Grapperhaus wants heavier penalties for financial cybercrime and has submitted a bill looking to punish phishing and other forms of payment fraud more severely.
If the bill becomes law, the maximum prison sentence for payment data obtained via cybercrime will be increased to three years, from two, Grapperhaus said in an explanatory memorandum. Anyone who falsifies payment details or applications could receive a maximum of six years in prison. One year will be given for criminals who possess or resell payment details.
The maximum sentence for some computer offenses will also be increased in those cases where crimes relate to payment instruments or are committed with the aim of unlawful advantage. Finally, the reach of some counterfeiting crimes will be broadened from payment cards to other non-cash payment instruments as well.
