BCCI Future of Ganguly & Shah likely to be decided on 9th Dec, matter listed in SC

BCCI Future of Sourav Ganguly & Jay Shah : This 9th December future of BCCI president Sourav Ganguly & Sec Jay Shah can be sealed. The Honorable Supreme Court is likely to decide on the BCCI’s plea which has asked for removal of ‘cooling off’ clause for the office bearers. A Supreme Court bench, headed by Justice L Nageswara Rao, has called for final hearing of the BCCI matter on December 9. Both Ganguly and Shah as per the existing constitution have completed their 6 years term as office bearer of the BCCI or any state association.

But both Ganguly and Shah have been running the BCCI despite there tenures coming to an end in July and May 2020 respectively. According to a report in Outlook, in an order passed by a three-judge Supreme Court bench headed by Justice L Nageswara Rao, the matter to decide the fate of these two will come up for “final hearing on December 9.” This is the first time that the Supreme Court has indicated that they would want to close this matter as it was not taken up for months due to the coronavirus pandemic and low priority.

It is worth noting that the BCCI treasurer Arun Dhumal filed the petition in April this year asking for half a dozen changes in the constitution. Among the amendments sought, the BCCI wanted the three-year cooling off period on the office bearers to be taken out even after completion of 6 years term as BCCI or State official.

BCCI Future of Sourav Ganguly & Jay Shah : The Background of the matter ?

In 2018, the Supreme Court of India approved the new constitution of the BCCI that was drawn up by the CoA (Committee of Administrators) based on the Lodha Committee’s recommendations to restructure the board. The key point in the Lodha committee’s recommendations of the cooling off period was that an official has to undergo the mandatory cooling-off period after two consecutive three-year terms at the BCCI or state, or a combination of both.

But in complete defiance of the constitution Ganguly, Shah and Jayesh George have continued to be the BCCI official. But it seems now their fate is likely to be sealed on 9th Dec.
