Blow to LDF govt as SC dismisses its appeal against CBI investigation in Periya double murder case

Kasaragod, Dec 1 (UNI) Giving yet another blow to the CPI-M led LDF Government, the Supreme court on Tuesday declined to admit an appeal filed by the state government pleading stalling of investigation by the CBI in the controversial Periya double murder case.
The state government had challenged in September 2020, the Order of a Division Bench of Kerala High Court upholding its single bench order that permitted CBI investigation in the Periya murder case.
The prosecution case, which the local police and then the Crime Branch wing of Kerala had investigated, was that a group of people in connivance with local Marxist leaders, hacked to death the two Youth Congress workers Kripesh and Sarath Lal in Periya of Kasaragod district on February 17, 2019.
Citing lapses in the investigation by the Crime Branch, the parents of the victims had approached the high court seeking a CBI investigation in the case. They alleged that many who were involved in the crime were not listed as accused in the crime.
Acting on the petition, a single bench of the High Court had ordered a CBI investigation on September 30, 2019.
Alleged to be in fear of a possible exposure of the role of Marxist leaders, the LDF Government had on October 26 last year had filed an appeal against the single bench order which permitted a CBI probe in the case.
The contention of the Government was that the probe by the Crime Branch was progressing efficiently.
Though the state government had appealed against the single bench order, a Division Bench of the Kerala High court in August 2020 had dismissed the plea of the state government against the order of a single bench directing a CBI probe into the Periya double murder case.
The Crime Branch had no option but to transfer the case diaries to CBI who will further investigate the case, retaining the charge sheet filed by the crime branch, as directed by the High Court. However, this did not happen and the crime branch delayed the transfer.
Expressing surprise over the State’s motives behind trying to block the CBI inquiry, the Apex Court observed shock and anguish over the non-transfer of case diaries to the CBI despite the Order of the High Court order permitting a CBI investigation, sources revealed.
The Top Court also went on to ridicule the state government by asking the relevance and need for such an appeal, sources said.
Sathyanarayanan, father of Sarath Lal and Krishnan, father of Kripesh welcomed the decision of the apex court saying they believe in the judiciary and had fullest confidence that it would allow a CBI investigation which would expose all conspiracies behind the crime.
“Instead of protecting the interest of the victims, the Government was trying desperately to protect the criminals who conspired the crime. An authority supposed to protect the lives and properties of the citizens was spending crores to protect criminals by opposing CBI investigation”, Sathyanarayanan told the media after the apex court said this afternoon that it will not entertain the government's petition and dismissed it.
The strong remarks and focused observations against the state government while dismissing its appeal against the HC division bench order has been hard hitting and lambasting the intentions of the state government behind trying to stall an investigation by the CBI as desired by the victims’ parents.
