Canadian regulator warns some app companies about anti-spam obligations

Canadian regulator CRTC has with the country’s Competition Bureau issued letters to 36 companies involved in the mobile applications industry, telling them to review their practices and take preventive or corrective measures where necessary. The letter reminded the companies about their obligations under Canada’s Anti-Spam Legislation (CASL). No company was specifically named.

Under the rules, companies must not make false or misleading claims to promote a product, service or business interest. They must also not collect or use any personal data without consent. Apps should properly identify their functions in order to get this consent, and should not spam user friends or contacts. “These activities put Canadians at risk of fraud, identity theft and financial loss, among other things,” CRTC said.

The regulator noted that about 90 percent of Canadians subscribe to mobile services and that over 80 percent of people 18 and up own a smartphone.
