Commission slaps fine, directs replacement free of cost

Installing a defective navigation system has cost an automobile seller dear as the District Consumer Disputes Redressal Commission Chandigarh has not only directed the agency to replace the complete music system having in-built GPS navigation system with a new one carrying fresh warranty, free of cost, but also directed to pay Rs15,000 towards compensation on account of deficiency in service and causing mental and physical harassment to the complainant.

The commission has also directed the dealer to pay Rs 7, 000 as cost of litigation to the consumer. Himat Singh, a city resident, filed the complaint before the consumer commission after the navigation system of his car stopped working normally soon after he purchased the vehicle.

Himat said that he purchased Honda City i-vtech (petrol) car (top model) on February 3, 2016, from automobile dealer in Ambala Cantt, for Rs11.50 lakh. The car had GPS navigation (in-built with music system), he added.

He reported the matter to dealer during first service and was assured by its service engineer that it would be rectified, but nothing was done.

The consumer faced a lot of problems due to the defective GPS navigation system of the car. The dealer sent the GPS navigation system of the car for repair to the service centre in Chandigarh, but still it did not work properly.

On the other hand dealer denied the allegation and stated that the GPS navigation was replaced, hence no further indulgence was required. Pleading no deficiency in service and denying other allegations, the dealer prayed for dismissal of the complaint.

After hearing arguments the consumer commission directed respondents, which include the dealer, service centre and the manufacturer of the navigation system, to replace the complete music system having in-built GPS navigation system with a new one, carrying fresh warranty, free of cost.

They have also been directed to pay Rs15,000 to the complainant towards compensation on account of deficiency in service and causing mental and physical harassment to him.
