NHRC to investigate Dhenkanal Shelter home sexual abuse case

Kendrapara, Nov 13 (UNI) The National Human Rights Commission (NHRC)will investigate the death and exploitation of Children in Shelter homes in Dhenkanal district in Odisha through its Special Rapporteur.
Expressing serious concern over the report of Dhenkanal District Collector that the Children victims are not covered under Compensation Rules, the NHRC directed the District Collector to move an application immediately before the concerned court through Prosecutor under Rule 7 of POCSO Rules, 2012, for compensation and submit a compliance report within Six weeks.
Adjudicating a petition filed by Activist-Lawyer Radhakanta Tripathy, the Apex right body put various queries before the State Authorities and sought reports.
Mr Tripathy in his petition alleged that a victim minor student Sambhunath Nayak was found dead on July 2, 2019, in Laxminarayan Gurukul Ashram in Dhenkanal District.
In the same district, Good News India Shelter Home, located at Belatikri orphans, was running for years where minor children were sexually exploited besides other violations of legal provisions.
As the NHRC sought for Action Taken Reports from DGP Government of Odisha and Chief Secretary in the matter, the Collector, Dhenkanal informed the Commission that upon enquiry it was found that both Laxminarayan Gurukul Ashram and Good News India have been closed, the accused have been arrested and all the measures for rescue and rehabilitation of these children have been taken.
Finding lacunae in the Collector’s report, the NHRC sought to know as to what legal action has been taken against the culprits.
The NHRC also sought to know how the shelter homes are running illegally, how many of them are there in the area, what kind of children are living there, who is managing these institutions.
The NHRC planned to enquire the cases from 05.10.2020 to 09.10.2020 wherein, Mr Tripathy was requested to join the enquiry. On the back-drop of the Covid -19 and feedback of the petitioner, the Spot enquiry has been postponed.
Mr Tripathy further said that the State earlier reported in a case filed by him (Case No 2485/18/0/2016), Government of Odisha has notified “The Odisha Victim Compensation Scheme, 2017’ dated 31.03.2017 and Anti Human Trafficking Units has been constituted, Police Officer designated as Child Welfare Officer in each Police Station and constitute of Juvenile Police Unit in each District of the State.
While disposing of a case of 2014 filed by Mr Tripathy, 176 students of Gatangi Sevashram school in Kandhamal district have been compensated one thousand rupees each in the year 2017, as they had to take mid-day meal with dogs and pigs due to lack of boundary wall and precaution by the School Authorities.
MrTripathy submitted that though the situation in both the cases has been sub-judice, there are several illegal shelter homes operated in the State.
He urged the NHRC to conduct a thorough investigation of the episode in the entire state of Odisha compiling all the cases in this matter together and clubbing reports submitted by the NCPCR in this matter.
Perusing the reports of Dhenkanal Collector, the NHRC is of the view that it is wrong to report that children are not covered under law for compensation.
The case is posted for hearing on December 28 next.
