POINGUINIM: The sessions court at Margao is likely to hear, on November 12, an application filed seeking cancellation of bail granted to actor Poonam Pandey and her husband Sam Bombay. The police had arrested them following a complaint of posting a video on social media, hurting public sentiments.
Judicial magistrate first class (JMFC), Canacona, Shanoor Audi, had granted conditional bail to the duo.
The applicant, Samrat Bhagat, while stating that viewing of the video exposes, prima facie, the nature of the obscenity and indecency, said that the JMFC erred in holding that “one cannot, given the facts and circumstances, come to a conclusion that all nudity is obscene”, without viewing the video.
Bhagat said that the police had not verified and confirmed that the camera and memory card submitted by the accused was used to record and edit the video. .
