Haryana state employment of local candidates Bill will need president approval for it to become a law as it goes against Article 14 and 19 of the Indian constitution which advocates equality before law and right to practice any profession anywhere in the country.
A decision in the case of companies invoking the exemption will be taken by a "designated officer" serving as representative of the government. Such officer will also have a power to direct concerned companies to provide training to local candidates to make them suitable for job.
Within three months of Bill becoming the Law, companies must register details of the staff members who drew salary of less than 50,000 rupees a month. Failure to do so will attract fines of rupees 25,000 to 1,00,000. Once law is implemented it becomes mandatory for companies to employ locals in 75% of jobs which pay less than 50,000 rupees a month.
