‘Custodial gang-rape’ plea: Notice to Haryana

Punjab and Haryana high court
CHANDIGARH: In a twist to the case related to murder of two police personnel in Haryana’s Sonipat district in July this year after an accused in the case, identified as Amit, was killed in police encounter, the mother of girl arrested in connection with the case has claimed that the deceased cops were molesting her daughter and her cousin, who also was arrested in the case.
The woman said that the deceased Amit, who had allegedly killed the cops, had only tried to save the two girls from the cops who were molesting them and demanding they accompany them to the police station for a night.
Horrifyingly, the woman also claimed that her daughter was gang-raped around 10 times after her arrest in the case on July 2. Making these claims in a petition filed before the Punjab and Haryana high court on Tuesday, she claimed that despite an FIR about the gang-rape, the Sonipat police were yet to take any action against the guilty cops.
Taking cognizance of the “serious allegations” levelled by the petitioner, the HC issued notice to the Haryana government, DGP and Sonipat SP, seeking their reply on the contentions raised by November 16.
Petitioner seeks medical treatment for survivor
In her petition, the woman who belongs to Sonipat district, informed the HC that she is mother of the 17-year-old survivor and the aunt of 20-yearold woman, both of whom are accused in the murder case of two cops. Two police officials, including a constable and an SPO, who were on patrolling duty were found murdered in front of Haryali Park of Butana village in Sonipat district in July this year.
According to the petitioner, when she came to know about the involvement of Amit in the incident, she took both the girls to the police station to join the investigation. She also claimed that the police killed Amit in a fake encounter and booked both the girls for murder. She alleged that during police custody, her daughter was gang-raped several times by cops inside the police station. Her niece was also molested. According to the petitioner, foreign objects were also inserted inside their private parts during police custody. She had specifically named three cops against whom FIR has been registered but no action has been taken against them till date.
The petitioner contended that following her complaint about rape and molestation of the two girls in police custody, she has not been allowed to meet them in jail. She has also sought directions for immediate medical treatment of the custodial gang rape survivor and a thorough medical examination by the medical board constituted out of the state of Haryana.
In the detailed petition, the petitioner claimed that both the girls are crucial witnesses to the incident, as police had killed Amit in the fake encounter because he had tried to save these girls from the deceased cops from molestation.
