BJP leader and lawyer Ashwani Kumar Upadhyay filed a petition in the Supreme Court demanding transfer of the cases under consideration in various High Courts against the minority status of the five communities. These communities include Muslims, Christians, Sikhs, Buddhists, and Parsis.
The petition, filed by advocate Ashwani Kumar Dubey, said that all cases challenging the constitutional validity of Section 2C of the 1992 National Minorities Commission Act to be transferred to the High Court of Delhi, Meghalaya, and Guwahati. It said that in order to avoid the plurality of cases and conflicting views in different places, we want that all the cases should be heard in one place.
It was argued that the denial of minority rights to genuine minorities is wrong. In such a case, these petitions should be heard simultaneously. Apart from this, the petition has demanded a minority of Hindus in six states and two union territories. It argues that in the 2011 Census the population of Hindus has decreased in these places.
According to the 2011 census, Mizoram has a 2.75% Hindu population. Similarly, Nagaland has 8.75 percent, Meghalaya 11.53 percent, Arunachal Pradesh 29, Manipur 31.39, and Punjab has 38.40 percent Hindu population. Apart from this, 28.44 in the Union Territory of Jammu and Kashmir and only 2.5 percent of the population in Lakshadweep is Hindu.
