Prospectus won’t be issued for medical admissions till decision on reservation bill, TN tells HC

Madurai, Oct 16 (UNI) Tamil Nadu government on Friday told the Madurai Bench of the Madras High Court that “until a decision is taken by the Governor on the assent to the Bill on implementing 7.5 per cent horizontal reservation for NEET qualified students from government schools in the undergraduate medical admissions, the prospectus for admissions will not be issued.”
The court was hearing a batch of public interest litigation petitions seeking a direction to the State to implement horizontal reservation for government school students as recommended by the commission headed by retired HC Judge P.Kalaiyarasan.
During the course of the hearing, the Advocate General Vijay Narayan informed the Division Bench comprising Justices N.Kirubakaran and B.Pugalendhi that no decision was taken by the Governor on giving his assent to the Bill, which was unanimously passed by Tamil Nadu Legislative Assembly.
Till then the prospectus notice will not be issued for medical admissions, he said.
Justice Kirubakaran broke down in tears after observing that if no decision was taken immediately with regard to horizontal reservation for government school students, only fewer students would get admission and the interests of the government school students would be affected.
A decision has to be taken at the earliest to safeguard the interest of government school students, the Judge said.
The division bench said as per data available, in the last three years only three, five and six students from government schools got admission in medical colleges. Hence, a decision had to be taken with regard to the implementation of the Tamil Nadu Admissions to UG courses in Medicine, Dentistry, Indian Medicine and Homeopathy on Preferential Basis to Students of Government Schools Bill, 2020.
The court had observed that the Bill was passed by Tamil Nadu Legislative Assembly unanimously on September 15 and sent to the Governor for his assent on the very same day. However, it had been pending for one month without any decision being taken on it.
Justice Kalaiyarasan Committee had recommended that 10 percent of seats for admission to the MBBS course can be set apart on a preferential basis to students, who studied from Class VI to Higher Secondary Course in State government schools and who have qualified in NEET.
