Won’t arrest Rhea Chakraborty in second FIR, says NCB

MUMBAI: The NCB has said that they will study the HC order on Rhea Chakraborty’s bail before deciding to approach the Supreme Court in appeal. “We haven’t got a copy of the order yet. The decision to go in appeal for cancellation of bail will be taken after examining the order,” said Ashok Mutha Jain, deputy director of NCB.
Officials said that they will not arrest Rhea in the second FIR registered by the Delhi unit of the NCB which is probing the larger issue of consumption of drugs in Bollywood. “It amounts to double jeopardy. Under Article 20 of the Constitution, a person cannot be prosecuted and punished for the same offence a second time,” an official said. Rhea was arrested in the Mumbai case where she was accused of arranging and financing ganja for Sushant Singh Rajput.
The HC order is the second setback for the NCB in the last one week. On Saturday, a special NDPS court refused to extend the NCB custody of another accused Kshitij Prasad, who was briefly with Karan Johar’s production house. Kshitij, who alleged that NCB forced him to falsely implicate several celebrities in the alleged case of consumption of drugs, was remanded to judicial custody till October 20.
