Madras HC dismisses bail pleas of 3 policemen accused in Sathankulam custodial deaths case

Madurai, Oct 1 (UNI) The Madurai Bench of the Madras High Court on Thursday dismissed the second bail petitions of three police constables, accused in the custodial deaths of traders P.Jayaraj and his son J.Bennicks at Sathankulam in Thoothukudi district.
During the hearing of the bail petitions of S.Murugan, X.Thomas Francis and M.Muthuraj, who were among 10 policemen arrested in connection with the case, the Central Bureau of Investigation (CBI) which is probing the case submitted that it had filed a combined charge sheet in two cases pertaining to the custodial deaths case before the Madurai Chief Judicial Magistrate Court on September 25.

The CBI also informed the court that 105 witnesses had been examined and all the 10 police men, including the three petitioners had been involved in the assault of the father-son duo at Sathankulam police station.

The Special Sub Inspector of Police (SSI) Pauldurai, one of the accused in the case died of COVID-19.

While Murugan had filed a false case against Jayaraj and Bennicks, Muthuraj had signed as witness in the complaint. Francis was guarding the Sathankulam police station door to ensure that nobody came in and he also had caught hold of Bennicks hand, while he had been beaten up by other policemen.

Taking cognizance of the submissions, Justice V.Bharathidasan dismissed the bail petitions. The bail could not be granted to the petitioners as investigation was progressing, the Judge said.
The CBI investigation revealed that the father-son duo were arrested in the evening of June 19 for opening their shop beyond the permissible time and tortured at the Sathankulam police station by the accused cops in the evening as well as in the intervening night, consequent to which both of them succumbed to the injuries and died in the intervening night of June 22 and 23 at the Kovilpatti government hospital.
