Delhi High Court's division bench of Justice Vipin Sanghi and Justice Rajnish Bhatnagar adjourned the hearing on the appeal filed by Brajesh Thakur, who was senteced to life term by a trial court in the Muzaffarpur shelter home case, till October 1.

Challenging the decision of the trial court, Thakur in his plea before the High Court said the trial court has failed to appreciate that a case relating to rape the prosecution must first and foremost establish that an accused is potent and thereby capable of committing the alleged act.

"The said fact needs to be established by the prosecution as a foundational fact without which the entire case of the prosecution will collapse," the plea said.

"...the hurried manner in which the trial was conducted by the trial court was a violation of inter alia the right of the appellant to a free and fair trial guaranteed under Article 21 of the Constitution of India," the plea further said.

Thakur for sentenced life imprisonment by a Delhi Court in February this year after he was held guilty under Section 376 (rape), 376D (gangrape), 323 (voluntarily causing hurt), 324 (causing hurt by dangerous weapons or means), 120B (criminal conspiracy), and 109 (abetment) of the Indian Penal Code.

Thakur, a former Bihar People's Party legislator, was also found guilty under Section 6 and 17 of Protection of Children from Sexual Offences (POCSO) Act and Section 75 of Juvenile Justice Act. The court, however, acquitted one accused.

The case pertains to the allegations that several girl inmates of the shelter home were sexually assaulted. Thakur heads an state-funded NGO named Sewa Sankalp Evam Vikas Samiti which ran the shelter home.

The matter came to light following a audit report by the Tata Institute of Social Sciences (TISS).

Thakur was the prime accused in the case while others were employees of his shelter home and Bihar Social Welfare Department officials.

The case was transferred from Bihar Police to the CBI in July 2018.

The court had on March 20, 2019, framed charges against the accused for offences of criminal conspiracy to commit rape and penetrative sexual assault against minors.

The case was, however, transferred from a local court in Muzaffarpur to the POCSO court at Saket here last year on the Supreme Court's directions.

Pune: Ventilator-supported ICU beds too few for demand

PUNE: Care for critical Covid-19 patients continued to be a challenge, as only seven ventilator- supported ICU beds were vacant across the city and Pimpri Chinchwad municipal limits on Tuesday evening.
The oxygen supply system augmentation work at Sassoon General Hospital has added to the problem, as the state-run hospital will not be able to admit new patients for ow. The hospital’s administrative controller, S Chockalingam, told TOI that the oxygen supply system augmentation started from Monday and around 40 patients had to be internally shifted for the work.
“Since we could not shift our patients to other facilities across Pune and Pimpri Chinchwad municipal limits, we have decided to continue with the work internally. It will take another 12 days to complete the oxygen supply network at the new building that caters to around 500 patients,” he said.
“The patients’ inflow has not stopped and the hospital gets around 45-50 new patients every day,” Chockalingam said, urging the patient’s families to arrange hospitalisation as suggested by the administration.

    CHANDIGARH: Terming the legislation a “direct and deliberate assault” by the Centre on the interests of the farmers, Punjab chief minister Amarinder Singh said on Tuesday that the state Congress will challenge the Essential Commodities (Amendment) Act 2020, which was passed in the Lok Sabha on Tuesday, in the court of law.
    Riding roughshod over the concerns of the farmers, the central government, of which the Shiromani Akali Dal (SAD) is a constituent, has imposed a central law on a state subject, thus eroding the federal structure of the country, said Amarinder. “We will challenge it in court,” he said.
    Asserting that he will not allow the interests of the farmers to be compromised in this “shameless” manner, Amarinder said the enactment of the legislation is clearly a step towards abolition of the MSP regime. “It is a conspiracy on the part of the BJP-led NDA government to destroy Punjab and its farmers,” he said, declaring that the Congress will fight this attack on the state’s interests tooth and nail.
    “The legislation talks of encouraging competition among farmers. Do they really expect the poor farmers, who are only competing with themselves for survival every day, to rival big corporates for protecting their interests?” asked Amarinder.
    Noting that the enactment, along with the other two farm ordinances that the Centre has already tabled in the Lok Sabha, was in line with the recommendations of the Shanta Kumar committee, Captain Amarinder pointed out that the same committee had also suggested dismantling of the MSP regime.
    Sukhbir, SAD party to Centre’s treachery: CM
    It is evident that the NDA government is now moving towards the elimination of the MSP system, which is the lifeline of the farmers, he said, adding that the Punjab Congress will not allow the interests of the farming community to be trampled in this manner. The very survival of the farmers is at stake, he warned.
    He also criticised SAD chief Sukhbir Badal, who was present in the House when the Bill was passed by voice vote, for failing to protect the interests of Punjab’s farmers, whose messiah he claimed his party to be. “Sukhbir and his SAD were clearly party to the treachery of the Union government, which has paved the way, through the passage of this bill, for taking away the rights of the farmers, who have fed the nation and given it food security for decades,” he added.
    “Will you quit the ruling coalition at the Centre, or will you continue to wait outside their doors for any crumbs they throw your way?” Amarinder asked Sukhbir, adding that the Akalis had totally and irrevocably failed their own state yet again.
    Amarinder said the only legacy that the incumbent Akali chief was promoting was of a party that will always put its own interests over those of Punjab’s people, particularly the farmers.
