Senior advocate Rajeev Dhavan, appearing for Bhushan (in photo), said that larger questions of law would be dealt with in the matter and assistance of Attorney General was required to be taken.

The Supreme Court on Thursday agreed to seek Attorney General K K Venugopal’s assistance in the 2009 contempt case against Advocate Prashant Bhushan and journalist Tarun Tejpal.

A bench of Justices A M Khanwilkar, Dinesh Maheshwari and Sanjiv Khanna accepted the request of Senior Advocate Rajeev Dhavan that the Attorney General’s views be sought in the matter as it involved larger questions of law.

The bench directed that the case records be forwarded to the office of the Attorney General. The court will now hear the matter in the week commencing October 12.

The case relates to comments allegedly against the judiciary in an interview to Tehelka magazine in 2009. The matter was earlier listed before a bench headed by Justice Arun Mishra, who has retired. On August 24, the bench said it will be listed before a different bench.

The August 24 bench had said some of the questions framed by the court in the matter “have certain ramifications” and said it would like to hear on whether such statements can be made against sitting and former judges.
