MUMBAI: Bombay high court ordered Brihanmumbai Municipal Corporation (BMC) to stay the demolition it launched on Wednesday morning at Kangana Ranawat’s bungalow. Justice SJ Kathawalla heard the matter and asked BMC to file a reply and posted the matter for detailed hearing on Thursday at 3pm.
The actor’s lawyer, Rizwan Siddiqui, raised several questions against the BMC and HC wants to hear a moot question on how the civic staff entered the premises.
Shiv Sena-ruled Brihanmumbai Municipal Corporation started demolition of alleged unauthorised constructions at actor Kangana Ranaut’s recently renovated bungalow at Pali Hill area of Bandra (west) on Wednesday, a few hours before her scheduled arrival at the city airport around 2.30pm.
Kangana created controversy recently when she raised doubt on Mumbai Police while commenting on Sushant Singh Rajput’s alleged suicide incident after stating that she feared the Mumbai Police more than the ‘movie mafia’. She also compared Mumbai with Pakistan-occupied Kashmir. It upset Shiv Sena and the party activist protested against Kangana.
Kangana filed a petition before the HC and sought urgent hearing on Wednesday against the “illegal, arbitrary and mala fide’’ action of the BMC.
Kangana's petition said that the notices issued by the BMC were “without application of mind, in violation of principles of natural justice, unreasonable and improper," and ought to be set aside by the high court.
Kangana’s lawyer Siddiquee had replied to BMC notice on Tuesday. On Wedneday, the BMC H/west ward officer in its order to Kangana said "After scrutinizing all the papers and on site visit inspection, I am satisfied that the work mentioned in the notice schedule found is in progress." The order said that the allegations in her reply were "found to be baseless."
The BMC said, “It has been noticed that after receipt of the notice you have not stopped carrying the work." The BMC “rejected” her reply and observing that she had "failed to produce permission to changes in approved the BCC plan and therefore work carried out by you is declared unauthorized." The BMC order said that since she had not stopped work, it was "liable for forthwith demolition." The BMC order also said, “Further note that under Section 475-A of MMC Act, you shall be punished with imprisonment for a term of not less than one month, but which may extend to a year and with fine which shall not be less than Rs 5,000 but which may extend to Rs 25,000 and in case of a continuing offence with further daily fine which may extend to Rs 500."
