25% NLSIU local quota: Karnataka HC grants interim stay

BENGALURU: The Karnataka HC on Tuesday granted interim stay on implementation of the National Law School India University's (NLSIU) (Amendment) Act 2020 which provides 25% quota for state students.
A division bench headed by Justice BV Nagarathna passed the order considering a memo submitted by NLSIU which said the varsity is conducting its own National Law Admission Test (NLAT) on September 12 and has disassociated itself from Common Law Aptitude Test (CLAT).
The bench said the admission list to be prepared by NLSIU will be provisional in nature and subject to final orders of the court. On September 1, the bench had reserved its verdict on a batch of petitions challenging the constitutional validity of the new NLSIU law. The petitions were filed by an aspirant, an alumnus and the Bar Council of India.
Decision on Act not possible prior to NLSIU exam
A couple of days later, NLSIU announced it would hold its own entrance test, NLAT. The decision was communicated to the high court. NLSIU said repeated postponements of CLAT had forced it to conduct its own test.
However, since one of the parties is an aspirant for a seat in the institution, the high court intervened as it was not possible to decide the issue of constitutional validity of NLSIU Amendment Act before September 12, the date ofNLAT.
