MUMBAI: The Supreme Court on Thursday stayed the default bail order granted by Bombay high court to DHFL promoters, brothers Kapil and Dheeraj Wadhawan, in a money laundering case connected with the alleged Yes Bank fraud.
A bench of Justices S K Kaul, Ajay Rastogi and Aniruddha Bose posted a special leave petition filed by Enforcement Directorate (ED) against the HC order for hearing on October 7. S V Raju, additional solicitor general for ED, said the agency had sent an email regarding the chargesheet on the 58th day. For the Wadhawans, senior counsel Mukul Rohatgi and Amit Desai sought to oppose the ED plea.
On August 20, Justice Bharati Dangre of the HC had granted the Wadhwans bail on a PR bond of Rs 1 lakh each as the ED filed its chargesheet on July 13, a day after the stipulated 60-day period. The HC had agreed with Wadhawans' counsel Amit Desai that the first day of remand is included in counting 60 days, but the ED said it is excluded.
The Supreme Court said that it would examine the legal issue.
