No bail to boy accused of killing Class II kid in Gurugram

NEW DELHI: The Supreme Court on Wednesday refused to grant bail to a boy accused of killing a seven-year-old student in a private school in Gurugram in 2017.
The accused, also a student of the same school and who was around 17 years old at the time of crime, was taken into custody for allegedly stabbing a Class II student. The accused has been in custody for the last 33 months.
Senior advocate Siddharth Luthra, appearing for the accused, contended that the accused should be released on bail as the issue of juvenility is still pending in court. He said the probe conducted by CBI is "appalling" and the boy should not suffer due to delay in trial proceedings.
A bench of Justices R F Nariman, Navin Sinha and Indira Banerjee, however, was not convinced and turned down the bail plea. But the court agreed to give an early hearing to adjudicate on whether the accused should be tried as an adult in the murder case.
"Since the petitioner is now being tried for the purposes of bail only as an adult, we see no reason to interfere with the impugned judgement of the high court at this stage. Accordingly, the special leave petition is dismissed," the bench said.
