Stuck in Surat for over 3 years, Pakistani man allowed to return home

Giving relief to a 28-year-old Pakistani citizen who has been stuck in Surat since 2016 following his arrest in a fake currency case, the Gujarat High Court on Monday granted him permission to leave the country.

Gujarat High Court asked DSP of Surat Railway Police to Issue the No-Objection Certificate to Pakistani national Sajjad Vora after he was acquitted by the Supreme Court in a fake currency note case. Pakistan high commission had filed a habeas corpus petition in Gujarat High court as the local authorities did not grant him permission to go back to Pakistan despite the fact that he was acquitted by the lower court and high court.

The government had filed an appeal before the Supreme Court but it was rejected, paving way for Vora's departure to his native country.

Vora's lawyer Aum Kotwal said, “After the Supreme Court dismissed the appeal against the acquittal, the petition of Pakistan High Commission was disposed by HC, directing DSP Surat Railway to issue NOC to Vora by August 29 so that he could travel to his country.”

The lawyer further said, “The court has directed the Foreigners Regional Registration Office (FRRO) to issue the Exit permit and waive all fees of overstay within a period of 7 days from date of NOC. The original visa permit and exit permits has to be given to him and he is allowed to go back to his country the way he pleases."

Munir Satti, an official of the Pakistan High Commission, had filed a habeas corpus petition earlier this week to get custody of Vora who was acquitted by Gujarat High Court in case of fake currency notes registered by Surat railway police in December 2016. The high court had confirmed the acquittal given by Surat lower court on July 15, 2019.

Vora could not go back to his nation as he needed permission from Surat police as his visa had ended in 2017. He applied for NOC from Surat police, but was not allowed to go back. Therefore, the Pakistan High Commission approached Gujarat HC by filling a habeas corpus plea on the ground that Vora had been illegally detained in India.
