MUMBAI: Bombay high court on Tuesday directed Arthur Road jail authorities to shift Rakesh Wadhawan, promoter and director of Housing Development and Infrastructure Ltd ( HDIL) to a civic-run KEM hospital and sought a report on an endoscopy and colonoscopy, if done. Wadhawan had moved the HC for permission to be shifted to a private hospital for the multiple ailments.
Rakesh, 67, and his son Sarang are facing a case of alleged Rs 4,000 crore money laundering in the Punjab and Maharashtra Cooperative (PMC) bank collapse case and have been in custody since last October.
The sessions court had on August 18 directed that he first be taken to KEM and for want of any facility on recommendation of the doctors, he could be transferred to a private hospital at his expenses. Wadhawan however rushed to the HC since he said endoscopy required specialized doctors and infrastructure and sought that he be taken to a private hospital to enable all tests be done at one go, under one hospital.
His counsel Amit Desai and Subir Kumar said that the state-run JJ had suggested an endoscopy and since they lacked the facilities had suggested he be transferred to the civic hospital.
H S Venegaonkar, counsel for Enforcement Directorate opposed Wadhawan’s plea and said his petition was not maintainable because there are disputed question of facts.
The HC bench of Justices R D Dhanuka and VG Bisht suggested that he can be taken to the civic hospital and his tests can be done there first as directed by the trial court.
The matter is now kept after two weeks. The HC also called for reports from jail chief medical officer on Wadhawan’s health status.
