Publisher Mia Freedman and her CEO husband will be kicked out of their lavish $12million mansion following a messy court battle.

Freedman, aka Mia Lavigne, and husband Jason Lavigne, have been embroiled in a legal stoush with the owner of the stately home in Sydney's east where they live.

The couple, who founded the news site Mamamia together, moved into the plush Bellevue Hill property, Fintry, five years ago with their three children.

The house at centre of the dispute has six bedrooms, a four car garage, a grand entrance foyer, towering ceilings, and panoramic ocean views.

The Lavignes had an agreement with home owner Somna Lala Kumar to rent the the mansion with the option to buy at a later date.

However, following a disagreement over settlement negotiations, Ms Kumar withdrew the contract and ordered the Lavignes out of her home.

One issue the two parties fought over was the leaking roof, which the Lavingnes claimed would cost $251,800 to fix.

The Lavignes took the case to the NSW Supreme Court in a bid to settle damages, interest and costs and to prove their agreement had not been validly terminated.

On Friday, Justice Rowan Darke ruled in Ms Kumar's favour saying she was entitled to have her home back.

Ms Kumar was also found to be entitled to rent due from December 2019 to June 2020, and a lump sum of $5,875 a week from June 4 until the Lavignes move out.

'I have found that the defendant validly terminated the contract for sale on 11 February 2020,' Justice Darke said, Sydney Morning Herald reported.

'On the conclusions I have reached, the plaintiffs were not entitled to remain in occupation after 3 June 2020.

'The plaintiffs should be allowed a reasonable period in order to vacate the property.'

Freedman is best known as editorial director of Mamamia, which touts itself as the country's largest digital media network for women.

Her husband is co-founder of the business and has tended to the commercial side of the brand, which they co-founded in 2007.

Freedman began her career at the now-defunct Cleo magazine and rose to prominence as the editor of Cosmopolitan magazine at just 24.

She became a household name for her writing and regular appearances on both reality and breakfast TV shows.

The Lavigne family have a long association with Bellevue Hill, having previously owned a $4.8 million home in the same area.

There is no specific date for the Lavignes to move out and the legal parties will return to court in two weeks with their proposals.
