Last year, Cummings made highly controversial comments on a podcast which saw him sacked by 3AW and the Footy WA TV show run by Crocmedia.
Cummings, alongside Swan and producer Ralph Horowitz, had been searching terms on website Urban Dictionary and laughed about a man masturbating on to a woman's face without her consent.
He soon apologised and said in August he 'felt sick' after reading their verbal exchange on paper.

'I am disappointed in myself. At the time I didn't see that they were demeaning,' Cummings said on Fox Footy.
'For some reason we started getting into a thing called Urban Dictionary. We didn't write any of the things, but it's made-up sexual positions.
'We would start it saying surely no one is doing this stuff, this is wrong and sick and twisted and then it all turned pear-shaped.
'We meant no harm and we were laughing at the sheer ridiculousness of things, but when I saw it in writing I felt crook in the guts.'

Cummings said in a statement he would be stepping down from the Humpday with Scotty and Swanny podcast and seek guidance from Domestic Violence Victoria to consider his actions and their potential impact.
But Swan refused to apologise for his comments and went to Twitter to slam those accusing them of wrongdoing.
'If we had of ever said anything wrong or offensive we would of apologised but the fact is we have never have and I'll debate anyone anywhere arguing that point,' he said.
The former Collingwood star started a new podcast in August called Swanny and Friends.
