A day after the Rajasthan High Court dismissed a petition by BJP MLA Madan Dilawar, seeking the disqualification of six BSP legislators who joined the Congress last year, the BJP MLA Tuesday filed two fresh writ petitions challenging the Assembly Speaker’s decision in the matter.
“In the first writ petition, we have challenged the communication sent to us by the Assembly Speaker yesterday, informing us that Dilawar’s petition has been rejected. This communication didn’t mention any date as to when our petition was rejected by the Speaker and we were not provided a copy of the original order. We were also not given any chance of a hearing. We filed a writ petition challenging this communication,” Dilawar’s counsel Ashish Sharma said.
Sharma said after the first writ petition was filed, Dilawar was given a copy of the Speaker’s decision rejecting his petition filed in March. “The order of the Speaker rejecting our petition is dated July 22. In the order, it has been said that the petition was rejected because the documents we furnished in support of our petition under Schedule X were not signed. This is a flimsy ground and reflects bias. It was important for us to challenge this too, as it was the principal order. Thereafter we filed our second writ petition…” Sharma said, adding the matter has been listed for hearing on Wednesday.
The petition had also questioned the Rajasthan Assembly Speaker’s “inaction” over a plea submitted by Dilawar in March, requesting the Speaker to disqualify the six legislators.
