Before getting killed, Vikas Dubey fired nine rounds, hit three policemen

NEW DELHI: Miraculously remaining unhurt in a overturned vehicle, gangster Vikas Dubey had snatched a pistol from the four policemen who lost consciousness being injured in the accident and fired nine rounds at Special Task Force policemen, hitting three of them before being killed in the return fire, UP government informed the Supreme Court on Friday.
Explaining the details of the incident, the UP government said Dubey while trying to escape fired nine bullets at policemen after escaping from the backdoor once the vehicle skidded and overturned due to heavy rain and when the driver attempted swerve to avoid a herd of cattle which suddenly appeared on the road. While all the four policemen in the overturned SUV were injured and lost consciousness, Dubey managed to snatch a pistol from them and attempted to flee but was challenged by the STF personnel which were following in another vehicle.
The STF led by deputy SP T B Singh asked Dubey to surrender, but he kept firing and fleeing. "A bullet hit Singh on the chest but he survived as he was wearing a bulletproof jacket. Head constable Sarvinder Singh Sengar suffered fire arm injury on the left arm while constable Bimal Kumar was hit on the left thigh. In self-defence, the STF team fired six bullets, three of which hit Dubey," the UP government said.
Answering the question how he could be shot on the front and not on back as he was fleeing, the UP government said he was facing the STF personnel when he was firing at them. As to why he was not handcuffed, the government said he was being brought by a team of 15 policemen so it did not feel necessary to handcuff him.
It said Dubey was sitting between two policemen when the vehicle met with an accident, but did not explain how Dubey remained unhurt and attempted to flee after snatching a pistol when other four policemen were injured in the accident and lost consciousness.
On the July 3 incident at Bikru village, the state said that Dubey, who was on parole in a case for which he was serving life sentence, organised a gag of 80-90 criminals to launch a surprise attack on the raiding police party in the dead of the night. Narrating the brutality of the attack, the government said after riddling the circle officer with bullets, the criminals cut off his legs. They also mutilated the body of slain policemen, it said and attached gory pictures of the mutilated bodies of the policemen killed at Bikru on July 3.
After the killing of eight policemen, the police searched Dubey's house and found sophisticated fire arms and dangerous ammunitions of different kinds embedded in the roof and walls. "Deadly weapons were found kept in hollow chambers made inside roof, walls and false ceilings. In the process of excavating the weapons and explosives from the hollow walls of the house, the load bearing capacity of the walls reduced and the building became insecure. Hence, JCB machine was used for further recovery. In the process of recovery, some parts of the building collapsed," it said.
The Yogi Adityanath government said that the state has already instituted a commission of inquiry headed by a retired Allahabad HC judge and set up a Special Investigation Team to inquire into all aspects of the incidents from July 3 till killing of Dubey and his associates in encounters.
These incidents and follow up actions already taken by the UP government has no parallel in the Telangana encounter killing case, in which the SC had appointed a three member inquiry committee headed by retired SC judge V S Sirpurkar. Hence, it would not be proper to to order a inquiry panel headed by retired SC judge into Dubey encounter killing and related incidents, it said.
