School fee payment: HC directs schools not to charge more than tuition fee or face action

CHANDIGARH: The Punjab and Haryana high Court has clearly spelt out that no private school can charge more than tuition fee and in fact gave warning to private schools to not to charge more than tuition fee from students failing which ,HC would take action as per law. The Chandigarh administration has also filed its reply in the case and Independent school association and others schools have stated that they will filed replication in the matter.
HC on last date of hearing had directed the private schools to not pass any adverse order against school going children in case parents are not able to pay the school fees. Hc has also clearly spelt out that in case any student wants to leave private school and shift to government school, private schools should not make any objections to it and issue school leaving certificate on immediate basis. The matter will come up for hearing on July 31.
HC clearly stated that no school canmcharge more than tuition fee from parents and in case schools fails to adhere to this and any compliant is received, HC will take action against those schools.
During the resumed hearing of case, the Chandigarh administration also filed its reply and stated that in order to provide relief to financially crippled parents, it has already waived off fee for students studying in government schools and as far as private schools are concerned these schools are entitled to tuition fee and not beyond that. It was also stated that education Institutions are not entitled to profiteering in whole of the writ petition there is no mention as to how much fees used to be collected by the school's prior to covid-19 pandemic and it has also not even been mentioned as to how many parents deposited fees in full during pandemic and how many parents have not deposited the fees.
The reply stated that that majority of schools have always propagated themselves to be smart schools fully equipped with computer and digital Technologies Chd administration stated that it cannot buy argument that any school has made any investment in technology platform device as all digital platforms like whatsapp, zoon are free of cost and no training is required to use it
Chandigarh administration mentioned that the petition filed is nothing but a sordid Saga of the proclaimed charitable public trust running away from duties in this tough times .They have proved that their charitable public trust only for the purpose of collect think donation and getting a large chunk of land allotted but when it comes to real Public Service development we can't be allowed to feed on human and social miseries education being noble profession cannot be a trade
Independent Schools Association Chandigarh(ISAC) along with 7 private schools have moved to Punjab and Haryana High court pleading to quash Chandigarh administration order which directs the private schools to reschedule the last date of deposit of fees and funds for session 2020-21 and schools were required to fix the last date by giving at least one month time to the parent after the reopening of the schools .Stating that reopening of schools is uncertain and meanwhile the schools have to disburse the salary of staff of staff and due to non payment of fees they are running out of funds. Also it was submitted that school s have done huge investment in technological platforms so that online classes keep on running and students do not suffer.
ISAC is an association of 78 unaided privately managed schools. It was stated that in order to ensure that students do not suffer in their curricular activities during 20202-21 academic session, the schools have been making painstaking efforts in proving education and holding classes thorough online platforms. Several schools have made investments in technologic platforms and devices in interest of students. Online timetable for classes also have been made. It was also submitted that the schools are being expected to continue to discharge their functions including disbursement of salaries to the staff and disseminating education through online technology to their students.
