Writ petition in SC for release of 2 Nigerians

Greater Noida: The wife of one of the two Nigerian men detained in Police Lines for the past eight months have moved a writ petition in Supreme Court seeking their immediate release. The petition has been filed under Article 32 of IPC that allows an individual to directly move to Supreme Court to seek justice when they their fundamental right has been ‘deprived'. The woman is Indian.
The petition argues that despite asking Noida Police and other concerned authorities several times, the charges under which Chima Paul Ugochukwu and Chinasa Victor Obioha were detained are unknown. “These persons have not been produced in any court till the drawing of the present petition and neither have these persons or their relatives or even the advocates have been informed or intimated the reasons for their detention nor any case has been registered for their detention,” said the petition.
The petition has requested the court to direct Noida police to produce all the documents regarding their detention for a review before court, and also requests the court to consider giving a long term visa or a status of refugee to the two detainees. Kamlesh Mishra, their lawyer told TOI that even after the DG asked Noida Police to look into the matter on June 7, no action was taken. TNN
