NEW DELHI: The investigation seems to be targeted only towards one end, remarked a Delhi court in connection with the police's probe into an Unlawful Activities (Prevention) Act (UAPA) case against Jamia Milia student Iqbal Tanha. The court, which was hearing proceedings regarding Tanha’s judicial custody, said that the police's case diary had revealed this “disturbing fact” and upon inquiry as to what probe was being carried out against the “rival faction” the police officials failed to respond.
“Perusal of the case diary reveals a disturbing fact. The investigation seems to be targeted only towards one end. Upon inquiry from inspectors Lokesh and Anil, they have failed to point out what investigation has been carried out so far regarding the involvement of the rival faction. In view of the same DCP concerned is required to monitor the investigation and ensure fair investigation,” said special judge Dharmender Rana.
During the proceedings, Tanha was remanded to judicial custody for 30 days till June 25. He was produced from police custody on May 27 at the judge's residence when inspector Lokesh informed the court that he was "actively" involved in the "communal riots" that hit northeast Delhi in February this year.
Court's attention was drawn towards the statement of one of the witnesses showing "specific allegations" against Tanha. Though the court remanded Tanha to judicial custody, it observed that the investigation had been “only targeted towards one end” and asking DCP to ensure a fair probe.
A resident of Jharkhand’s Hazaribagh, Tanha lived in Abul Fazl Enclave and was pursuing a bachelor’s course in Arabic from Jamia. He was also one of the leaders of the United against Hate movement. The police allaged that WhatsApp chats have suggested that Tanha was actively involved in the conspiracy, which led to the violence that killed over 50 people in northeast Delhi.
According to the police, Tanha, an office bearer of the Students Islamic Organisation, was allegedly found to be instigating students to resort to violence during the anti-CAA protests outside Jamia in December last year. He was arrested on the basis of the eyewitness accounts.
The FIR registered at the Jamia Nagar police station after the violence had named Tanha along with student leader, Chandan Kumar, and former MLA, Asif Muhammad Khan. It is alleged that in several videos, Tanha was seen leading students who later got violent and pelted stones. It is also alleged Tanha had also asked his followers to block the road near the Jamia even as a mob had gone berserk and burnt several DTC buses.
