MADURAI: The
Madras high court has dismissed a public interest litigation seeking to cancel a
quarry licence granted to a person in Sivaganga district, citing that the litigation appears to be a motivated one.
A division bench of Justice P N Prakash and Justice B Pugalendhi passed the order while hearing a petition filed by N Rajesh Kannan who sought to cancel the quarry
licence issued to P S K Balasubramanian on the ground that he was illegally quarrying sand in violation of the conditions of licence.
The judges noted that even in the affidavit, the petitioner has stated that he had earlier filed another petition seeking a direction to the revenue authorities to stop Balasubramanian from quarrying sand.
The judges observed that these facts clearly showed that there was no public interest involved in the case and the litigation appeared to be motivated.
