Thane man held for killing three-year-old walks free as cops fail 'miserably' to prove charges

THANE: A 25-year-old accused of kidnapping and murdering a 3-year-old was acquitted recently as the prosecution "failed miserably" to prove charges. Badal Sarkar, a carpenter from Thane, was recently acquitted by district judge H M Patwardhan.
The boy's body was found in a gutter on January 9, 2015, a day after he went missing.
A drunk Sarkar often visited the boy's home and the kid's mother had complained to Sarkar's family, angering him, the prosecution said. He got even bitter when he was not invited to the boy's birthday celebration on December 29,2014.
The prosecution said that Sarkar held a grudge against the family and to avenge this, he kidnapped the boy on January 8, killed him and dumped the body in the gutter.
However, the defence said that the prosecution did not prove that the boy was last seen with Sarkar. The prosecution had copied footage from cameras in a pen drive but not given it to the court.
The judge said that the prosecution had failed miserably to prove the charges and let Sarkar off, giving him the benefit of doubt.
