Application not maintainable: Ex-CJI

NEW DELHI: As the question of whether the Supreme Court will accept the UNHCHR plea to be made amicus curiae engages attention, a former Chief Justice of India told TOI, “I would have dismissed the UNHCHR application seeking to become amicus in the CAA case.
Their application is not maintainable”. “An amicus is appointed by court, not imposed upon it. If this is permitted, then tomorrow all UN bodies can attempt to become amicus in all contentious matters. It will open the doors for even embassies and high commissions of different countries to seek to become amicus in many issues pending before the Supreme Court,” the former CJI added.
