NEW DELHI: Reacting to the transfer of Delhi High Court Justice S Muralidhar to the Punjab and Haryana High Court, law minister Ravi Shankar Prasad on Thursday tweeted that the transfer was done pursuant to the recommendation of the Supreme Court collegium headed by the Chief Justice of India.
"Transfer of Hon’ble Justice Muralidhar was done pursuant to the recommendation dated 12.02.2020 of the Supreme Court collegium headed by Chief Justice of India," the law minister tweeted.
"While transferring the judge consent of the judge is taken. The well settled process have been followed," Prasad said.
Delhi HC Judge S Muralidhar was transferred to the Punjab and Haryana High Court, days after the Supreme Court collegium made the recommendation.
The judge was hearing the Delhi violence case and the late evening notification came on the day when a bench headed by him expressed "anguish" over the Delhi Police's failure to register FIRs against alleged hate speeches by three BJP leaders.
Terming it a routine transfer, Prasad rebutted Congress' charge that the move was politically motivated.
Earlier, Congress spokesperson Randeep Surjewala while addressing the media slammed the Centre for the transfer, and said "It seems those doing justice in country will now not be spared."
Calling the transfer a classic "hit-and-run injustice" by the BJP government, he said the saffron party's "politics of revenge" has been exposed.
A notification issued by the Ministry of Law and Justice states that the President took the decision on the transfer of Justice Muralidhar after consulting the Chief Justice of India.
The notification, however, does not mention when he has to take charge at his new posting.
