GHAZIABAD: A Ghaziabad court on Monday sentenced a 23-year-old man to life imprisonment for the rape and murder of a seven-year-old girl in October 2018.
The court has also imposed a fine of Rs 2.2 lakh on the convict, half of which will be given to the victim’s family. After the crime, he had packed the body in a gunny bag and hid it on the roof of a mosque in Muradnagar.
Special judge (POCSO Act) Mahendra Srivastava found Muzib guilty under IPC sections 364, 302, 201, 376 (A and D), 377 and under sections 5 (g, i, m) and section 6 of the POCSO Act.
Special public prosecutor (POCSO Act) Utkarsh Vats said, “The court observed that the convict was involved in a heinous crime. He was found guilty on the basis of the last seen evidence. We had examined 10 witnesses altogether during the hearings.”
Muzib was accompanied by his minor nephew in the October 6 crime. The duo, neighbours of the girl, committed the crime when she had gone to buy a packet of chips.
While Muzib worked with a pharmaceutical company in Himachal Pradesh, his nephew was a school student.
The minor had gone missing in the afternoon of October 6 and her body was found in the mosque the next morning.
Former special public prosecutor (POCSO Act) and the counsel for the girl’s family said: “The convict had lured her to his house where he along with the minor sexually assaulted her. The duo had gaged her mouth and later murdered her using a string. They hid the body inside the room and during the night they shifted it to their terrace and later to the roof of the mosque.”
Since his arrest, Muzib was lodged at Dasna jail.
Muzib was awarded life imprisonment and Rs 50,000 in fine under each count of IPC sections 302 (murder), 376 A (Punishment for causing death or resulting in persistent vegetative state of victim) and 376 D (gang rape). Under the IPC sections 377 (unnatural offences) and 364 (Kidnapping or abducting in order to murder), the judge awarded 10 years rigorous imprisonment and Rs 25,000 in penalty on each count to the convict. Muzib was sentenced to seven years in jail and Rs 20,000 in fine under IPC section 201 (Causing disappearance of evidence of offence, or giving false information to screen offender). All the sentences will run concurrently.
