AHMEDABAD: The Gujarat high court on Monday granted
permission to a 13-year-old rape survivor for
abortion of 23-week pregnancy. The teenager was allegedly raped by her maternal uncle.
Justice SH Vora directed a team of doctors at the
Civil Hospital to examine the girl and after having interaction with her, they should undertake the procedure of surgery on urgent basis, if there is a consensus among the doctors that termination would be carried out safely.
Since the case involved allegations of rape, the HC has directed the doctors to take necessary tissue samples for the process of DNA identification and hand them over to the investigating officer.
Advocate Mehul Surati, who represented the girl’s mother, said that the high court has permitted the girl to apply for interim compensation before the chairman of
Ahmedabad District Legal Service Authority. On her request, the authority should award interim compensation in accordance with the law, which stipulates compensation for rape survivors.
The teen and her mother approached the high court last week after a city sessions court denied abortion permission saying that the Medical Termination of Pregnancy (Amendment) Bill, which proposes that abortion is permitted before the pregnancy is of 24 weeks, has not become a law yet.
