The Supreme Court now clarified that under the SC-ST Act, a preliminary inquiry is not required before the arrest. In this case, the Supreme Court even stated in its judgment that in such cases there will be no need to allow any authority before filing an FIR.

The Bench of Supreme Court Justices Arun Mishra, Justice Vineet Saran and Justice Ravindra Bhat have upheld the amendments of the Central Government. However, the Supreme Court said that the accused can go to the court for the cancellation of the FIR against him. Earlier, the Narendra Modi government of the Center made several amendments in this law after the Supreme Court's decision on the SC / ST Act in 2018.
