Gold Coast ex-wife jailed over hit-man plot to face retrial

A woman jailed for trying to hire a hit man to kill her ex-husband has had her conviction set aside on appeal.

Gold Coast woman Theresa Dalton will face a retrial in the Supreme Court for attempting to procure a person to murder Malcolm Stewart in 2010.

The Court of Appeal found the trial judge misdirected the jury and ordered a retrial in a decision published on Friday.

The former flight attendant was last year found guilty of arranging a hit on her ex-husband in 2010 after their marriage fell apart three years earlier.

She was sentenced to six years in prison and would have been eligible to apply for parole in August 2021.

Dalton allegedly wanted her husband of 24 years dead because she feared he'd take too big a slice of the $3 million in shared assets they were splitting.

She maintained her innocence during her sentencing, saying she had never once broken the law.

"I am innocent. I feel this has been a catastrophic miscarriage of justice," Dalton told the court.

A date has yet to be set for the retrial.
