Gujarat: Rape-murder convict to challenge death penalty in apex court

SURAT: The man, convicted of rape and murder of a three-year-old girl in Godadara, has written to state government expressing his desire to challenge the death penalty awarded to him by a court in July 2019, subsequently upheld by the high court.
Convict Anil Yadav wrote to superintendent of Lajpore Central Jail and state government saying he wants to challenge the death penalty awarded to him in Supreme Court. A local court has already issued death warrant to hang him at Ahmedabad Central Jail on February 29.
“I have received a written application from the convict saying he wants to challenge the death penalty in Supreme Court. I will forward his application to the state government for further action in the matter,’ said Manoj Ninama, superintendent at Lajpore Central Jail. Legal experts claimed the convict has right to challenge the verdict up to Supreme Court and can also file mercy petition. This may delay his execution, they said.
Additional sessions judge P S Kala had on Thursday issued death warrant against Yadav. The convict had challenged the death penalty awarded to him by the sessions court in high court but it was rejected in December 2019. The high court confirmed death sentence awarded to him after his conviction by ASJ Kala in July 2019.
Yadav was convicted of rape, murder, unnatural sex and attempt to destroy evidences. Prosecution had demanded capital punishment for him calling the crime rarest of rare. The minor had gone missing on the evening of October 14, 2018 and her body was found next morning packed in a plastic bag from Yadav’s house. Yadav was nabbed from Bihar on October 19 that year.
He was friend of the victim’s father. He initially helped in looking for the minor but later disappeared. He lived on ground floor of the same building where the minor girl lived with her family. Yadav had escaped to Bihar. He was hiding in Maniya village in Buxar district of Bihar from where he was nabbed by a team of Surat crime branch with help of Bihar police.
