Former J&K CM Farooq Abdullah detained under Public Safety Act

NEW DELHI: National Conference leader, former Jammu & Kashmir chief minister and sitting MP from Srinagar Farooq Abdullah has been detained under the Public Safety Act (PSA) at his residence by the Jammu & Kashmir home department.
The detention came just ahead of hearing on a petition filed by MDMK leader Vaiko in the Supreme Court challenging the "illegal" confinement of Abdullah following the abrogation of Article 370 in J&K.
Vaiko had contended that the NC leader was being deprived of his Constitutional rights on account of "illegal detention without any authority of law".
After Article 370 was rendered ineffective in J&K last month, Abdullah was under "unofficial" house-arrest with restrictions on his movement beyond the official residence. However, there was no paperwork to back the house-arrest or restrictions. With his formal detention under PSA, the authorities can now file a reply in the Supreme Court communicating the reasons and circumstances of his confinement.
Sources in J&K administration on Monday told TOI that Abdullah will remain at home during his detention under PSA - which has been duly approved by the advisory board set up by the J&K home department. His residence has been declared as a subsidiary jail for purpose of his detention. There shall be no bar on Abdullah meeting his relatives or friends, said sources.

While PSA allows a person to be detained for a maximum period of two years, certain time limits are to be adhered to. The initial validity of the detention is between 12 days and three months, followed by subsequent extensions as and when required.
The time-limit of detention under PSA is decided depending on the nature of the case or the person under detention.
