Accident Claim Tribunal (MACT) awarded over Rs 16 lakh to the family of a road accident victim. The petitioners had filed the claim petition under Section 166 of the Motor Vehicle (MV) Act, seeking compensation on account of the death of Guneet Singh alias Guneet Singh Dua in a road accident.
According to the claim petition, the accident took place on June 3, 2018, at around 12.30pm when Guneet Singh was travelling from Chandigarh railway station to CGC College, Landran, in a three-wheeler along with his father Harmeet Singh. After reaching the CGC College, when Guneet was paying the fare to the driver of the three-wheeler, a canter came at a fast pace and hit Guneet and the three-wheeler.
Due to the impact of the collision, Guneet received severe injuries. He was rushed to Sri Harkrishan Sahib Charitable Hospital, Mohali, where he was admitted and during the course of his medical treatment, he succumbed to his injuries on June 10, 2018.
After the accident, the driver got down from the canter, but when he saw Guneet’s serious, he fled from the spot of accident, leaving his canter.
It was stated that the accident took place due to rash and negligent driving of the canter driver without any fault of the deceased.
It was pleaded that Guneet Singh alias Guneet Singh Dua was 20 years old. He was self-employed and was earning Rs 25,000 per month. A sum of Rs 4 lakh was spent on the medical treatment of the deceased and an additional amount of Rs 50,000 was spent on his funeral expenses. In the end, a prayer was made for the grant of Rs 75 lakh as compensation.
After hearing the arguments, the MACT partly allowed the petition and directed insurance firm The New India Assurance Company Limited to pay the petitioners a compensation amounting to Rs 16.51 lakh along with the interest accrued at the rate of 6% per annum from the date of filing of the petition.
