On the petition challenging the UAPA Amendment 2019, the Supreme Court has issued a notice to the Central Government seeking answer. The petition has demanded that this law is against Articles 14, 19 and 21 of the Constitution. This amendment in the law gives the Central Government the authority to declare a person a terrorist.
SC has decided to examine amendments to Unlawful Activities Prevention Act that allows even individuals to be declared as terrorists without an opportunity of hearing. A bench of CJI and Justice Ashok Bhushan issued notice on a petition by Association for Protection or Civil Rights and an individual Sajal Awasthi.
Under UAPA Amendment 2019, Jaish-e-Mohammed chief Masood Azhar, Lashkar-e-Taiba founder Hafiz Muhammad Saeed, Mumbai terror attack accused Zaki-ur-Rehman-Lakhvi and fugitive mafia gangster Dawood Ibrahim were declared as terrorists.
