NEW DELHI: While rules give those excluded from the final NRC, 120 days to file appeals before foreigners' tribunals, the NRC authorities' preoccupation with securing NRC data as directed by Supreme Court, has for now held up the process of issuing certificates listing reasons for their exclusion.

The certificate is necessary to approach a foreigners' tribunal challenging exclusion from the NRC. As per the guidelines amended by the Centre, the 120 day time-limit was to start from August 31, the day of NRC publication. However, with indications that NRC authorities would take some time to secure the data before they start issuing certificates to the 19 lakh excluded people, a way out could be to approach the Supreme Court for delayed start of the 120-day time-limit.
The NRC coordinator is expected to approach the SC after fully securing NRC data. A review of threshold for the 120-day period may be sought alongside, suggesting that the time-limit be counted from the date on which the order of exclusion is served. The Centre has set up 200 foreigners' tribunals, in addition to the 100 already existing.
