CSI Diocese appeals against HC order

The Tinnevelly Diocesan Trust Association (TDTA) has appealed against a single bench order appointing two retired High Court Judges as administrators to manage affairs of the Diocesan Trust. TDTA, in its appeal, said that it was a company incorporated under the Companies Act.

Under Section 241 (1) of the Companies Act, 2013, any member of a company, who had grievances, should approach the National Company Law Tribunal for redressal.

TDTA said that it was aggrieved by the order and hence filed an appeal in the case. Questioning the appointment of administrators, it sought a stay. The petitioner added that the administrators had claimed that they had taken charge pursuant to the order of the court.

A single bench of the court had appointed former Chief Justice of Jammu and Kashmir High Court N. Paul Vasanthakumar and former Madras High Court judge P. Jyothimani as administrators of the Tirunelveli CSI Diocese and Tinnevelly Diocesan Trust Association (TDTA) to control the affairs of the Diocese that was caught up in management issues.

Hearing the appeal, a Division Bench of Justices T.S. Sivagnanam and R. Tharani ordered notice to the respondents and adjourned the hearing to September 25.
