NEW DELHI: In a report submitted to the
Supreme Court on
Friday, the monitoring committee informed that it had received 329 cases for permanent de-sealing of shops till August 14. And of them, 214 cases have been either disposed or dismissed during its hearings. The
SC-appointed panel was revived in 2017 by the apex court, and was entrusted with the task of taking action against unauthorised construction in the city. Over the last 20 months, around 6,500 commercial units across the city, including in prominent markets like
Hauz Khas,
Defence Colony, Greater Kailash and
Green Park, were sealed by the civic agency for land use violation.
“In those 329 cases, applicants had sought our intervention for de-sealing property after submitting an amount of Rs 1 lakh, an affidavit and application, explaining reasons or ground on which the property should be de-sealed. But no assurance was given from our side that their properties will be de-sealed for sure after taking fees,” said a member of the monitoring committee. “We are asking for detailed information from the municipal corporation regarding actual use of property allowed as per the master plan,” said the official.
The monitoring committee claimed to have collected an amount of Rs 3.39 crore from applicants and deposited the same in the bank. The member of the panel, however, clarified that no permission or order for de-sealing of properties has been issued in other cases over the past 20 months.
Earlier, both the SDMC and the North MCD had come out with a set of guidelines to help owners get their shops de-sealed again.
Regarding misuse of plots in Masoodpur area, the panel told the SC that the DDA had failed to perform the assigned task of shifting the dairy farm. “It was on the contrary encouraging the dairy owners to construct multi-storey residential-cum-commercial complexes, including warehouses. The DDA is duty bound to take action against the violators and retrieve the government land.”
When contacted, a senior DDA official denied to have detailed information on this matter. “But once a non-development area is transferred to the MCD, it becomes its responsibility to check the unauthorized construction,” said the official.
