MADURAI: The state government on Wednesday informed the Madras high court that a visually impaired medical aspirant, J Vibin, who was denied admission in a medical college due to his impairment, has been admitted in the MBBS course Tirunelveli Medical College Hospital. Taking note of the submission made in its compliance report, a division bench of justice K Ravichandrabaabu and justice Senthilkumar Ramamoorthy closed the petition.

In his contempt petition, Vibin, a minor boy represented by his father Jabakar, a resident of Tirunelveli district stated that he had filed a petition before the high court Madurai bench seeking to admit his son in the Pudukkottai Medical College to pursue MBBS.

When the petition had come up for hearing earlier, the court directed the authorities concerned to accept the certificate issued by the Madras Medical College categorizing the petitioner’s son as suffering from 90% degree disability (visual impairment) and implement the allotment already made in the Pudukkottai Medical College or may allot any other college within Tamil Nadu. The petitioner further submitted that the state government appealed against the order, but it was dismissed by the division bench. The court then directed the authorities to allot a seat for the petitioner for 2019-2020 academic year.

As the authorities failed to comply with the order, the petitioner filed a contempt petition and prayed for a direction from the HC seeking to take action against them.

It maybe recalled that after the petitioner filed a contempt petition, the state government filed a special leave petition (SLP) before the Supreme Court against it. However, the Supreme Court dismissed the SLP.

Since the SLP was dismissed, the state government during the previous hearing gave an undertaking before the court stating that after the central government surrenders the seats under all India quota, the petitioner would be allotted seat under BC category.
