AHMEDABAD: A special POCSO
court on Tuesday handed down exemplary punishment to a 42-year-old man in a case of eve-teasing and stalking of a minor, and sent him to
jail for three years.
The case involved Ranchhod Parmar, a resident of Majurgam near Geeta Mandir bus stop, who used to harass a 15-year-old girl for six months during her commute to school. When Parmar stopped her on August 25, 2014, and told her that he would take her on a ride in an aeroplane ( chaal, tane viman ma besadi fervu), the girl complained about his behaviour to her parents. She also told her parents that Parmar was stalking her on her way to school.
An FIR was lodged with Kagdapith police and Parmar was booked under Section 354D of the IPC and Section 12 of the Protection of Children from Sexual Offences (POCSO) Act. Both sections prescribe a maximum punishment of three years.
The accused was arrested on September 18, 2014 and police filed a chargesheet against him.
During the trial, public prosecutor examined the victim, her parents and two policemen involved in the investigation, and relied on three documents including the birth certificate of the girl to establish that Parmar's action was a violation of POCSO Act. He sought exemplary punishment for the accused and submitted that had it not been for the boldness on of the minor victim, people like the accused go scot-free and it becomes unsafe for women and girls to move around.
After hearing the case, special POCSO judge N P Syed held Parmar guilty and sentenced him to three years in jail.
