HC notices to heritage panel, PWD in Bharat Van PIL

Nagpur: Nagpur bench of Bombay high court on Wednesday added two more respondents in the suo motu PIL opposing the proposed road through the small forest in Bharat Nagar. The road will connect to the road at Maharashtra Jeevan Pradhikaran’s (MJP) office near Telangkhedi Hanuman Temple.
A division bench comprising justices Ravi Deshpande and Vinay Joshi issued notices to newly added respondents — Nagpur Municipal Corporation’s (NMC) Heritage Committee and State Public Works Department — asking them to reply within three weeks.
Earlier, amicus curiae Kartik Shukul filed a pursis pointing out that the first permission for the proposed road was granted by the heritage panel and, therefore, it must be asked on which basis it had allowed the proposal.
The suo motu PIL was based on a letter by environmental activist Jaydeep Das, where he cited TOI reports highlighting respondents’ plans to construct a temporary road, which would pass through a lush green patch on the Panjabrao Deshmukh Krishi Vidyapeeth’s (PDKV) land, but involves felling of over 500 fully grown trees.

During the first hearing on February 28, the HC had stayed respondents’ plan to lay the road by felling trees. Later, on March 29, it issued notices to respondents, including the chief secretary, NMC and MahaMetro.
In the last hearing, the amicus prayed for appointing National Environmental Engineering Research Institute (Neeri) or any other competent agency to study the impact of infrastructure works being undertaken around the Telangkhedi Lake and give a report regarding environmental impact of these projects. He also demanded stay on the tender notice of January 1, issued by NMC for beautification of Telangkhedi lake and restraining it from felling the trees for proposed road.
