Nagpur: Justice Rohit Deo of Nagpur bench of Bombay high court has on Monday granted interim bail to Sanjay Temgire in a case of molestation. Temgire, posted at Ajni police station, was booked on charges of rape and also provisions under Atrocity Act following a complaint by a woman who was the sister of a complainant in a murder case.
The court has now given two weeks time to the prosecution to file their reply against the plea filed by the officer.
Temgire, investigation officer of the murder case, had summoned the woman to the police station late in the evening for probe related work. He had also sent her a movie ticket on mobile phone. The woman, miffed by the advances by the officer, had lodged a complaint with Ajni police station. The offence was registered following intervention of zonal DCP Raj Tilak Raushan.
The sessions court had earlier rejected the anticipatory bail plea of PSI Temgire on the grounds that Atrocity Act was invoked in the case which barred anticipatory bail. The order of the sessions court was challenged by defence counsel Sameer Sonwane before the high court on the grounds of precedents.
“We had brought to fore the previous judgements before the court that anticipatory bail can be sought in cases booked under Atrocity Act on the ground that it was invoked without proper grounds. There was no mention in the complaint that the officer’ so-called behaviour was based on caste or there was any physical attempt,” he said. Sonwane was assisted by advocate Amit Thakur.
