Nagpur: The Nagpur bench of Bombay high court on Friday adjourned the pleas filed by Naxal sympathizers Vara Vara Rao and lawyer Surendra Gadling challenging their detention for their alleged role in an arson case of 2016 where around 80 vehicles were torched at Surjagarh in Gadchiroli.
Justice Rohit Deo deferred the hearing by two weeks after the petitioners’ counsel Firdos Mirza and Nihansingh Rathod sought time to decide on their future course of action, as the prayer clause of not filing charge sheet within 90 days was already rendered infructuous.
According to them, only academic arguments are remaining in the case regarding the petitioners’ detention, which they feel was illegal and made while ignoring rules.
Rao and Gadling challenged additional month’s time granted to Gadchiroli police for filing the charge sheet against them. They contended that the police had failed to file a charge sheet within stipulated period of 90 days. However, the cops were granted additional time of 30 days to file charge sheet, which is contrary to the law.
